  • TERMS AND CONDITIONS FOR PUDDLE DUCKS CLASSES - 21st DECEMBER 2017 

    1.        OUR TERMS

    1.1      Please note that any mention of ‘Puddle Ducks’ in these terms and conditions covers both Puddle Ducks branded classes and Swim Academy branded classes.

    1.2      All those wishing to attend a Puddle Ducks class must agree to the terms and conditions set out below. In the unlikely event of a customer failing to abide by these terms and conditions, a customer may be requested to discontinue lessons with Puddle Ducks. In this instance Puddle Ducks will be under no obligation to provide a refund for any outstanding lessons.

    1.3      What these terms cover. These are the terms and conditions on which we provide Puddle Ducks swimming classes to you.

    1.4      Why you should read them. Please read these terms carefully before you book our classes. These terms tell you who we are, how we will provide classes to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

    2.        INFORMATION ABOUT US AND HOW TO CONTACT US

    2.1      Who we are. We are Puddle Ducks Franchising Ltd a company registered in England and Wales. Our company registration number is 05879603 and our registered office is at The Grain Store, Hollins Farm, Off Twemlow Lane, Holmes Chapel, Cheshire, CW4 8GE. Our registered VAT number is VAT no. 895926259.

    2.2      How to contact us. You can contact us by telephoning our customer service team at 01477 410083 or by writing to us at info@puddleducks.com. 

    2.3      How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us when you booked.

    2.4      ”Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.

    3.        OUR CONTRACT WITH YOU 

    3.1      Booking a class

    3.1.1 You can make a class booking over the phone with your local Puddle Ducks office or online at www.puddleducks.com.

    3.1.2 You must provide us with specific personal information in order to book a class with us. Full details of the information required is in our ‘Data Protection and online security’ section.

    3.1.3 Once your booking is in place you will receive a confirmation email detailing what you have booked and providing you with links to relevant class and pool information, our latest Terms & Conditions and access to your personal ‘My Puddle Ducks’ account page where you can view your payment details at which point a contract will come into existence between you and us.

    3.1.4 It is your responsibility to change the generic ‘My Puddle Ducks’ account password issued by Puddle Ducks for first access or when re-setting a forgotten password via your local office. This should be a confidential password, unique to you, which you should keep safe and secure.

    3.1.5 Payment for classes must be made in advance for blocks of multiple lessons, your local Puddle Ducks team will be able to advise on the number.

    3.1.6 If you are using a Puddle Ducks Swimming gift voucher to pay, or part pay, for a block of lessons: 

    3.1.6.1 please note that no change can be given if the cost is less than the voucher value.  However, a credit will be added to your customer account for future use;

    3.1.6.2 if you have classes or class fees for more than 1 child in your basket, the gift voucher will be applied to the child whose class fee is largest or added to your basket first;

    3.1.6.3 please note that our gift vouchers expire 6 months after the date of purchase.

    3.1.7 You will be reminded when your next payment is due by email and text. The due date and amount will also be visible on your ‘My Puddle Ducks’ account page.

    3.1.8 All class timetables are correct at time of publishing. If your class time changes, your local office will communicate with you.

    3.1.9 If payments are made on time your place in the class is secure. After the payment due date places are not guaranteed and will be offered to any customers waiting for a place in that class.

    3.1.10 Holiday classes and photoshoots are run as separate events to our regular classes. Payment for these will be taken separately to your regular class and does not affect your regular payment due dates. 

    3.1.11 All of our prices include standard rate VAT where applicable. 

    3.2      Last minute lesson changes or cancellations by Us

    3.2.1 In the unlikely event of ‘last minute’ lesson changes or a lesson cancellation by us, you will be notified by us, by text message to your mobile phone, with as much notice as possible. Puddle Ducks will not reimburse any expenses caused by a customer failing to pick up their message.

    3.2.2 If a lesson is cancelled by Puddle Ducks, we will offer you either (i) a place at a replacement class – this will be in the form of a class cancellation voucher (which has a cash value equivalent to the cancelled lesson and an expiry date six months from the date of issue); or (ii) “the Credit Option” - a credit for the value of the cancelled lesson to be added to your account. If you have been given the Credit Option and intend to book another session of lessons your next payment amount will be reduced by the equivalent value. 

    3.2.3 Should you decide not to book another session of lessons, we will refund the class cancellation voucher or credit to you.

    3.2.4 If your lesson is cancelled part way through, you will only be credited if you were in attendance, and for the part of the lesson that had to be cancelled, on a pro-rata basis.

    3.2.5 If insufficient children are booked into your class, we reserve the right to cancel the class. In this instance you will be fully credited for any remaining lessons after the cancellation has occurred.  We will offer you either (i) an alternative class or (ii) a monetary refund will be given.

    3.3      Recurring Payments

    3.3.1 You are able to take advantage of our ‘Recurring Payment’ option by clicking on the ‘Sign up for recurring payments’ button within your ‘My Puddle Ducks’ account.

    3.3.2 By completing the authorisation you are allowing Puddle Ducks to take automatic payments on the next payment due dates until such a time as you cancel this authorisation.

    3.3.3  Puddle Ducks will notify you by email in advance of the amount to be taken from your card and the date this will occur. The amount to be taken will be the cost of the next block of lessons, based on the current class price, reduced by any credits that are on your account e.g. cancelled class credits or goodwill voucher amounts. We will then notify you once the payment has been successfully processed.  All your payment information will also be visible on your ‘My Puddle Ducks’ account payments page.

    3.3.4 If payments are made on or before the next due date, your child’s place in the class is secure.

    3.3.5 After the payment due date, if a recurring payment has failed, places are not guaranteed and will be offered to any customers waiting for a place in that class. Please note it is your responsibility to ensure the card details stored by Sage Pay are valid.

    3.3.6 If you have signed up for Recurring Payments but would like to use one of our 'Puddle Ducks Swimming Gift Vouchers' to pay or part pay for a block of lessons please phone your local Puddle Ducks team at least one week before your next payment is due to be taken and they will process this for you.

    3.3.7 To cancel your ‘Recurring Payment’ please contact your local Puddle Ducks team by email at least one week before your next payment is due to be taken

    3.4      Catch Up Lessons

    3.4.1 If you are unable to attend a lesson please let us know either through the ‘My Puddle Ducks’ area of our website or by contacting your local office. As a goodwill gesture, we will add a ‘Catch Up Voucher’ (of no cash value) to your account. This can be used to book an alternative lesson on a different day or time or at a different pool (this will mean that you will be swimming twice per week!), subject to availability, through the ‘My Puddle Ducks’ area of our website or over the phone with your local office.

    3.4.2  Please note that 'Catch Up lessons' CANNOT be added on to the end of a block of a lessons. They can only be taken by current paying customers. They cannot be used to extend the original time period of your paid-for lessons. 

    3.4.3  ‘Catch Up lesson’ bookings can only be made a maximum of 7 days in advance and up to 4pm on the day before the Catch Up Lesson is due to take place.

    3.4.4 If, having let us know you cannot attend your normal lesson, your circumstances change and you are able to attend the lesson, you must speak to your local Puddle Ducks office in case another ‘Catch Up lesson’ has been booked in your space. Please do not just turn up to your normal lesson as, if the class is full, you and/or your child will not be able to enter the pool for insurance reasons.

    3.4.5 Your payment has reserved your place just for you and if you miss a lesson for any reason we are unable to refund you. ‘Catch Up Vouchers’ are a goodwill gesture by us (Puddle Ducks) and no replacements or alternatives can be offered.

    3.4.6 If you are unable to attend a ‘Catch Up lesson’, either because there is no availability/space or because you don’t have the flexibility to travel to alternative options available, no replacements or alternatives can be offered.

    3.4.7 ‘Catch Up lessons’ can only be taken within your regular Puddle Ducks area.

    3.4.8 ‘Catch Up Vouchers’ have a 6 month expiry date and no cash value. 

    3.4.9 ‘Catch Up lessons’ can only be attended if a space is available. Should the space be taken by a new customer booking, we reserve the right to cancel the Catch Up lesson even at short notice. We will send you a text message to inform you if this happens and the ‘Catch Up Voucher’ will be re-added to your account.

    3.4.10 We do not give ‘Catch Up Vouchers’ for Holiday Class bookings and you are not able to redeem ‘Catch Up Vouchers’ for a Holiday Class booking (see 3.1.10).

    3.5      Cancellation Rights

    3.5.1 The cancellation rights generally available to consumers in accordance with their statutory rights do not apply to the classes provided by us.

    3.5.2 As a gesture of goodwill however we give our customers rights to cancel in certain circumstances referred to below.

    3.5.3  New Customers are children who are starting Puddle Ducks lessons for the first time (“New Customers”).

    For New Customers we offer a ‘Three lesson cancellation’ policy. This means that any time before 48 hours prior to a New Customer’s 4th scheduled lesson (whether or not that customer has attended the first 3 lessons) (“The New Customer Cancellation Period”) a New Customer can contact us in writing for a full refund of all the remaining lessons. If a New Customer cancels after the New Customer Cancellation Period or does not put their cancellation in writing the New Customer will not be eligible for a refund.

    3.5.4  We offer existing customers a 14 day “Change Your Mind” period commencing immediately after each payment is made for the next block of lessons, provided that the customer pays for their next block of lessons when payment is due and contacts us in writing (“Existing Customer Change Your Mind Period”). Please note that if existing customers fail to pay on the due date they will lose the right to Existing Customer Change Your Mind Period.  Cancellations received after the Existing Customer Change Your Mind Period are not eligible for a refund. Puddle Ducks reserve the right to apply this policy on a discretionary basis.

    3.5.5  Summer Holidays – We may at our discretion extend the Existing Customer Change Your Mind Period when Existing Customers pay for their next block of lessons which commence after the summer holidays.  In this circumstance an existing customer may cancel and receive a refund at any time up to 5 weeks before the lessons are due to recommence provided that (i) payment is made when due; and (ii) cancellation is made in writing  (“Summer Holiday Change Your Mind Period”). Cancellations received after the Summer Holiday Change Your Mind Period are not eligible for a refund.

    3.5.6 Tell us you want to change your mind - please let us know by emailing the local Puddle Ducks team indicated on your booking email.  Please provide your name, home address, details of the order and, where available, your phone number and email address.

    3.5.7 When we make your refund – we will make your refund if you change your mind within 14 days of you telling us you have changed your mind provided that you do so in accordance with this clause 3.5.  

    3.5.8  Our cancellation policy set out in the clause 3.5 does not apply to Holiday Class Bookings (see 3.1.10).

    3.6      Changes to our terms and conditions

    We reserve the right to make amendments to our Terms and Conditions at any time to reflect changes in our business or statutory obligations. The new version will be posted on our website and will take effect immediately upon posting. If applicable these changes will be communicated to all our customers by email. If you book lessons after the new Terms and Conditions have come into effect as part of your booking process you will indicate your agreement to be bound by them. Previous versions of our Terms and Conditions will be available for reference on our website.

    3.7      Behaviour and responsibilities

    3.7.1  All children attending the following Baby & Pre-school lessons: Floaties, Splashers, Kickers, Little Dippers and Dippers, must be accompanied in the water by their adult carer.

    3.7.2 Customers are responsible for the child in their care at all times (except during a lesson where the child is NOT accompanied in the water by an adult carer i.e. Swim Academy) and must inform the teacher prior to the lesson of any concerns they have. 

    3.7.3  If you need to bring a sibling along to your child’s lesson to be left poolside please check with your local Puddle Ducks office as the spectator policy at the pool may or may not allow this. The sibling is the responsibility of you as the parent/carer at all times. If the sibling needs attention on the poolside, it is the sole responsibility of you as the parent/carer to undertake this.  If you need to exit the pool, you cannot leave the swimmer with the teacher. Our recommendation is that you bring another supervising adult with you to the lesson.

    3.7.4 Customers are expected to behave in a civilised manner towards the teacher, other Puddle Ducks customers and any members of the public who are using the same pool, and are expected to refrain from using foul language at all times. 

    3.7.5 Puddle Ducks may, at its own discretion, refuse entry to a customer if it is felt that the customer’s behaviour is unacceptable. 

    3.7.6 Customers accept that at times there will be physical contact between the teacher and their child, which will always be carried out in a professional and caring manner.

    3.7.7 It is the customer’s responsibility to inform the local office and teacher of any condition that could affect their or their child’s capabilities in the swimming pool. You must agree to inform us of any changes, including pregnancy, as soon as you become aware of them. This can be updated via your ‘My Puddle Ducks’ area or by contacting your local office. All information provided to us will be treated as strictly confidential.

    3.7.8 Unfortunately, we can only accommodate one person in the pool at a time with each child who must be either the child's parent or designated carer and be at least 18 years of age. Anyone new to the class must let the teacher know at the beginning of the session so they can provide the extra help and advice that will be needed. Spectators may be allowed, depending on individual pool facilities and regulations, but must be other family members or friends. Please check with your local office before attending each lesson as individual pool regulations can change without notice.

    3.7.9 Customers must follow pool procedures as advised to them at the time of confirmation. Please adhere to the instructions given to you regarding car parking, entry and exit route to pools.

    3.7.10 Customers should aim to arrive no more than 15 minutes before the lesson and leave no more than 15 minutes after the lesson to help improve changing room comfort. 

    3.7.11 Car seats and push-chairs etc. should not be left in the changing rooms. Please contact your local office for details of where these can be left as this will depend on the individual pool facilities. There is strictly no push-chairs poolside at any pool.

    3.7.12 Food is strictly forbidden in the pool buildings.

    3.7.13 Please minimise mess on the floor e.g. mud or grass. Please inform a Puddle Ducks team member or pool staff if the floor is soiled.

    3.7.14  Smoking is strictly forbidden within any pool building or grounds.

    3.7.15 All Puddle Ducks teachers hold a teaching qualification from either the Swimming Teacher’s Association (STA) or Swim England, formerly known as the Amateur Swimming Association (ASA), the only official training providers of swimming teaching in the UK. In addition, all Puddle Ducks teachers undergo full in-house training to ensure they meet our rigorous teaching standards. All of our teachers are insured through either the STA or the IOS (insurance body for Swim England) and hold a lifesaving and safeguarding qualification as well as a valid DBS check. 

    3.7.16 The safety and well-being of your child or the child in your care is of the upmost importance to Puddle Ducks. We have a responsibility to report any inappropriate or suspicious behaviour to the relevant authorities. 

    WE DRAW YOUR ATTENTION TO THE CONTENTS OF THE FOLLOWING CLAUSE

    4.        OUR RESPONSIBILITY TO YOU 

    4.1      We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation. 

    4.2      In the absence of any proven negligence, lack of due diligence or breach of duty by the teacher(s), Puddle Ducks Franchising Ltd, its franchisees or employees, the participation of you, your spouse/partner, child or those in whose care you have placed your child for the purpose of attending or observing Puddle Ducks swimming sessions is done so entirely at your and their own risk.

    4.3      Puddle Ducks will not accept any liability for articles lost, damaged or stolen.

    4.4      Puddle Ducks cannot be held liable for the actions of third parties i.e. non-Puddle Ducks customers/team members and, therefore, excludes to the fullest extent possible by law, any liability arising from a breach of this section headed ‘Photography’ by any third party.

    4.5      These Terms and Conditions do not affect your statutory rights.

    5.        WHAT TO WEAR

    5.1      We operate a strict ‘double nappy’ policy for those children in Floaties, Splashers, Kickers and for any other children not yet fully toilet trained.  An approved snug-fitting neoprene swim nappy (such as our Puddle Ducks neoprene swim nappy or one of a similar design i.e. with snug fitting cuffs at the waist and legs) must be worn with a swim under-nappy (either a disposable paper swim nappy or a reusable cotton swim nappy with a disposable liner) underneath. Please gain approval from your local Puddle Ducks office if you are planning to use a neoprene swim nappy other than those available from our online shop. Children are welcome to wear swimming costumes, swim trunks, baby wetsuits and other similar garments but must still wear the ‘double nappy’ underneath if not fully toilet trained. Puddle Ducks reserves the right to refuse entry to any child who is not suitably dressed. 

    5.2      Children must remove loose fitting or sharp jewellery before swimming. Hoop earrings are not permitted.

    5.3      All Swim Academy children must wear swim hats in the pool. Children in our Dabblers classes are advised to wear swim hats in the pool.

    5.4      Adults must wear appropriate swimwear in the pool, remove loose fitting or sharp jewellery, tie back long hair or wear a swim hat.

    5.5      All plasters and hair clips must be removed before swimming due to the risk of them falling off in the water and damaging the pool filters. 

    5.6      Strictly no outdoor footwear poolside.

    5.7      Goggles – We do not permit children to wear goggles in our Floaties, Splashers or Kickers swimming classes. The adult carer is encouraged to bring goggles in Floaties and Splashers classes for certain underwater activities.

    5.8      In Baby & Pre-School classes children are permitted to wear prescription glasses only if they have a strap at the back to stop them falling off. Children with prescription glasses are NOT permitted to jump in whilst wearing them. In Swim Academy classes, prescription glasses are not permitted – they must be replaced by prescription goggles.

    6.        HEALTH AND SAFETY

    6.1      You must not bring your child swimming if they have any illness such as an ear infection, chicken pox, impetigo, conjunctivitis or a bad cold. We have been advised that you should not bring your child into the pool for 48 hours after sickness and 2 weeks after suffering from diarrhoea. For any other illness and to avoid any doubt please wait until your doctor has given the all-clear before returning to classes.

    6.2      Swimmers should not enter the pool until the teacher says it is safe to do so and must tell the teacher if leaving the pool before the end of the session 

    6.3      Always change your baby on the floor using a suitable changing mat. Do not use any raised areas such as benches, trolleys or tables. This is to prevent babies from rolling onto the floor from high surfaces which can easily happen and is extremely distressing for all concerned.

    6.4      Please take all your used nappies away with you unless a clearly marked nappy bin has been provided. Never leave nappies in an open bin (including those within the venue grounds).Please do not run or allow your child to run on the pool side, drink alcohol prior to the lesson, eat or chew gum during the lesson.

    6.5      All swimmers must shower before getting into the pool. Please do not wear makeup or body lotion etc. as these significantly deteriorate the quality of the pool water. 

    7.        PHOTOGRAPHY AND VIDEOS

    7.1      If you wish to take photographs or video footage during our lessons, you must adhere to the following terms:

    7.1.1 The taking of photographs can only take place in ‘splash time’ and must not interfere with the lesson. Photography at any other time is strictly not allowed.

    7.1.2  Due to the format of the classes, photography is not allowed in Dabblers or Swim Academy classes.

    7.1.3 Photography is only permitted if your child/relative is moved to the side of the pool away from the rest of the customers so that they are not visible in the photograph.

    7.1.4 Underwater photographs or underwater videos are forbidden.

    7.1.5 You may only take photographs and/or video footage of your own child unless you have prior agreement from the parent/guardian of other children.

    7.1.6 Parents who are concerned that their child is in the photograph taken by another customer have the right to ask to view that photograph and for it to be deleted if they are in fact in the shot.

    7.1.7  Please remain sensitive to the feelings of others and always stop filming should you be asked to do so.

    7.1.8 You must adhere to pool rules at individual venues, some of which do not permit the use of such equipment. If this is the case with your pool, we ask that you respect their policy.

    7.1.9 Photographs where the pool is shared with members of the public will not be permitted.

    7.1.10 Puddle Ducks expressly forbids the right to reproduce any part of our lesson content in any form (e.g. on the internet, DVDs, photographs etc.)

    7.1.11 Anyone suspected of continually filming or photographing the lessons for any purpose of publication will be asked to stop filming and leave the class.

    7.1.12 The teacher or poolside assistant in that lesson has the right to view the photographs taken and to delete any taken at the pool.

    7.1.13  Any customer seen to be taking photographs during the lesson may be asked to leave and will not be permitted to continue with their Puddle Ducks journey.

    7.1.14  In all instances the decision of the Puddle Ducks team member is final.

    8.        LOST PROPERTY AND VALUABLES

    8.1      All property left within any pool building or grounds including but not limited to: car park, entrance, spectators’ areas, changing areas and poolside area, is left at your own risk.  Please make sure you have all your belongings with you before leaving.

    8.2      Lost property will be kept for a period of 3 weeks if found by a Puddle Ducks team member. If not claimed, it will be disposed of accordingly. Unfortunately, if an item is not found by a Puddle Ducks team member we cannot be held liable.

    8.3      Please note odds and ends lost property such as shampoo, dummies, socks etc. will be disposed of at the end of each day.

    9.        AQUANATAL CLASSES 

    9.1      In addition to all our other Terms and Conditions, those detailed below are applicable to our Aquanatal customers:

    9.1.1 All pregnant ladies must complete a PARQ which is available from their local office. If any answer on this is ‘yes’ they will be required to produce a medical certificate. The PARQ and, if relevant, the medical certificate must be returned to the local office or teacher before participating in a class.

    9.1.2 Your due date will be required and will be displayed on our class registers in order to be used by our teachers to help tailor our classes to your individual needs. Please see our ‘Data protection and online security’ section for further details.

    9.2      FREE Aquanatal classes with one-off admin fee - You are able to attend these classes until your baby is born.

    9.3      Paid for Aquanatal classes (price per lesson with no admin fee) - You are able to attend for the number of classes that you have pre-paid for whether this is before or after your baby is born

    10.     TEACHERS

    Whilst we will try to ensure you always have the same teacher in a particular class, we cannot guarantee this as teachers may fall ill, leave or cancel for personal reasons. On occasion we may also need to have a new teacher join or lead your lesson in order to complete their teacher training or assessments. The quality of your lesson will in no way be affected by this though.

    11.      PROGRESSION THROUGH OUR SWIMMING PROGRAMME LEVELS

    Our programme levels are designed around a child’s physical and emotional development. Moving children into classes before a certain age could be physically difficult for them due to the activities we are doing but also emotionally as there is an expectation for them to understand instructions.  We have therefore applied a minimum age to each level which is based around these considerations and must be adhered to (please see http://www.puddleducks.com/programmes). 

    12.     DATA PROTECTION AND ONLINE SECURITY

    12.1   In order to book a Puddle Ducks class you must register your details and those of your child(ren) with us. These will include your real name, mobile and landline phone numbers, email address, home address, emergency contact details and any relevant conditions that could affect you or your child whilst in the pool. Aquanatal customers must also provide their baby’s due date.

    12.2   We share information provided to us within the Puddle Ducks group. This includes all Puddle Ducks franchises and Puddle Ducks Head Office. This is in order to improve our service to you or to contact you by email to let you know of our other services e.g. our online shop.

    12.3   You can choose to unsubscribe to marketing emails at any time.

    12.4   The names of you and your child(ren), their ages or your due date and a colour coded indication of any relevant medical conditions of you and your child(ren) will be displayed on our class registers in order to be used by our teachers to help tailor our classes to the individual needs of our customers. These registers are visible to other pool users and are used by selected pool operators for health and safety purposes.

    12.5   Please be assured that we will not share this data with any other third party other than those required to process your booking or where we are legally required to do so.

    12.6   On very rare occasions we may be obliged to disclose your personal information to third parties:

    12.6.1 Where we are legally required to disclose your information.

    12.6.2 To assist fraud protection and minimise credit risk. 

    12.7   Your email address will be used to create your ‘My Puddle Ducks’ account on our website and for all class communications. By providing us with an email address you are agreeing to receive communication from us by email.

    12.8   Any payment card details that you choose to save within our payment system will be held 100% securely by our payment processor ‘Sagepay’ who are PCI DSS Level 1 compliant.

    12.9   Your privacy and data security are of paramount importance to us but unfortunately the Internet is not a 100% secure channel of communication. Any data sent electronically to us is done so entirely at your own risk. Where you have chosen a password, to access certain parts of our website, you are responsible for keeping this password confidential.

    13.   OFFERS AND DISCOUNTS

    There are a selection of Offers and Discounts available to our customers but these are all subject to availability and valid at participating Franchises only.

    13.1   Introductory Offers

    13.1.1 Group discount – 10% discount on groups of 3 or more only. Only available for 1st booking. Must be booked over the phone with your local office. Children may be in different classes but all the classes must be with the same Franchise. Can be used in conjunction with Sibling Discount.  Cannot be used with any other Introductory or Promotional offers.

    13.2   Loyalty Discount

Can be applied across territories for participating Franchises when different pools are used by different siblings. Can be used with other Loyalty Discounts. Can be used in conjunction with an Introductory Offer or a Promotional Offer (either/or but not both).

    13.2.2  Recommend-a-friend Credit – If you are an existing customer and you introduce a new customer to Puddle Ducks classes you will both be awarded a £10 credit towards future payment for classes when the new customer pays for their class quoting your unique ‘Recommend-a-friend’ code (either online or over the phone with their local office). The credit cannot be added retrospectively. Can be used with Sibling Discount but no other Loyalty Discounts. Cannot be used with an Introductory Offer or Promotional Offer. No cash value. Expires after 6 months.

    13.2.3 Aquanatal-Floaties Discount – 20% discount for Aquanatal customers when they enrol for their first block of Floaties lessons. Must be booked before baby turns 6 months old.

    13.2.4 All Loyalty Discounts must be booked over the phone with your local office except for the Recommend-a-friend Credit which can also be used online. Can be applied across territories for participating Franchises. Can be used with Sibling Discount but no other Loyalty Discounts. Cannot be used with an Introductory Offer or Promotional Offer.

    13.3   Promotional offers

    We work with a select group of business partners to bring our customers a selection of great promotional offers.

    13.3.1 Valid for new customer bookings only.

    13.3.2 Promo code must be quoted at time of booking either online or over the phone with your local office. The offer cannot be added retrospectively.

    13.3.3 Subject to availability.

    13.3.4  Valid at participating franchises only.

    13.3.5 Must be used by set date as detailed in particular offer. If no date is given the maximum expiry is six months after publication.

    15.1.2 If the response is not satisfactory, please email a written complaint to your local Puddle Ducks office.

    15.1.3 If the response from your local Puddle Ducks office is not satisfactory, a written complaint should be submitted for the attention of the Office Manager at Puddle Ducks Head Office to the address above (see section 2.2).

    16.     OTHER IMPORTANT TERMS

    16.1   We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation.

    16.2   You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

    16.3   Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

    16.4   If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

    16.5   Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.

    16.6   Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.

    1.        OUR TERMS

    1.1      All those wishing to attend a Puddle Ducks Aquanatal class must agree to the terms and conditions set out below. In the unlikely event of a customer failing to abide by these terms and conditions, a customer may be requested to discontinue lessons with Puddle Ducks. In this instance Puddle Ducks will be under no obligation to provide a refund for any outstanding lessons or admin fee paid.

    1.2      What these terms cover. These are the terms and conditions on which we provide Puddle Ducks Aquanatal classes to you.

    1.3      Why you should read them. Please read these terms carefully before you book our classes. These terms tell you who we are, how we will provide classes to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss. 

    2.        INFORMATION ABOUT US AND HOW TO CONTACT US

    2.1      Who we are. We are Puddle Ducks Franchising Ltd a company registered in England and Wales. Our company registration number is 05879603 and our registered office is at The Grain Store, Hollins Farm, Off Twemlow Lane, Holmes Chapel, Cheshire, CW4 8GE. Our registered VAT number is VAT no. 895926259.

    2.2      How to contact us. You can contact us by telephoning our customer service team at 01477 410083 or by writing to us at info@puddleducks.com.

    2.3      How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us when you booked.

    2.4      ”Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.

    3.        OUR CONTRACT WITH YOU 

    3.1      Booking a class

    3.1.1  You can make an Aquanatal class booking over the phone with your local Puddle Ducks office. 

    3.1.2  You must complete a PARQ which is available from your local Puddle Ducks office. If any answer on this is ‘yes’ you will be required to produce a medical certificate. The PARQ and, if relevant, the medical certificate must be returned to your local office or teacher before participating in a class.

    3.1.3  Your due date will be required and will be displayed on our class registers in order to be used by our teachers to help tailor our classes to your individual needs. Please see our ‘Data protection and online security’ section for further details.

    3.1.4  There are two different payment models for Puddle Ducks Aquanatal classes. Your local Puddle Ducks office will advise which model is used for your chosen class.

    3.1.4.1    ‘FREE Aquanatal classes’ with one-off admin fee - You are able to attend these classes until your baby is born.

    3.1.4.2    ‘Paid for Aquanatal classes’ (price per lesson with no admin fee) - You are able to attend for the number of classes that you have pre-paid for whether this is before or after your baby is born

    3.1.5  Once your booking is in place you will receive a confirmation email detailing what you have booked and providing you with links to relevant class and pool information and our latest Terms & Conditions.

    3.1.6  All class timetables are correct at time of publishing. If your class time changes, your local office will communicate with you.

    3.1.7  All of our prices include standard rate VAT where applicable.

    3.2      Last minute lesson changes or cancellations by Us

    3.2.1  In the unlikely event of ‘last minute’ lesson changes or a lesson cancellation by us, you will be notified by us, by text message to your mobile phone, with as much notice as possible. Puddle Ducks will not reimburse any expenses caused by a customer failing to pick up their message.

    3.2.2   If a lesson is cancelled by Puddle Ducks, we will offer you either a place at a replacement class or, if you are attending ‘Paid for Aquanatal classes’ a monetary refund.

    3.2.3  In the case of ‘Paid for Aquanatal classes’, if your lesson is cancelled part way through, you will only be credited if you were in attendance, and for the part of the lesson that had to be cancelled, on a pro-rata basis. 

    3.2.4  If insufficient people are booked into your class, we reserve the right to cancel the class. In this instance we will offer you either an alternative class or a monetary refund of any monies paid.

    3.3      Cancellation Rights

    3.3.1  The cancellation rights generally available to consumers in accordance with their statutory rights do not apply to the classes provided by us.

    3.4      Changes to our terms and conditions

    We reserve the right to make amendments to our Terms and Conditions at any time to reflect changes in our business or statutory obligations. The new version will be posted on our website and will take effect immediately upon posting. If applicable these changes will be communicated to all our customers by email. If you book lessons after the new Terms and Conditions have come into effect as part of your booking process you will indicate your agreement to be bound by them. Previous versions of our Terms and Conditions will be available for reference on our website.

    3.5      Behaviour and responsibilities 

    3.5.1 Customers are expected to behave in a civilised manner towards the teacher, other Puddle Ducks customers and any members of the public who are using the same pool, and are expected to refrain from using foul language at all times.

    3.5.2  Puddle Ducks may, at its own discretion, refuse entry to a customer if it is felt that the customer’s behaviour is unacceptable.

    3.5.3  It is the customer’s responsibility to inform the local office and teacher of any condition that could affect their capabilities in the swimming pool. You must agree to inform us of any changes as soon as you become aware of them. All information provided to us will be treated as strictly confidential.

    3.5.4  Customers must follow pool procedures as advised to them at the time of confirmation. Please adhere to the instructions given to you regarding car parking, entry and exit route to pools.

    3.5.5  Customers should aim to arrive no more than 15 minutes before the lesson and leave no more than 15 minutes after the lesson to help improve changing room comfort. 

    3.5.6  Food is strictly forbidden in the pool buildings.

    3.5.7  Please minimise mess on the floor e.g. mud or grass. Please inform a Puddle Ducks team member or pool staff if the floor is soiled.

    3.5.8  Smoking is strictly forbidden within any pool building or grounds.

    3.5.9  All Puddle Ducks teachers hold a teaching qualification from either the Swimming Teacher’s Association (STA) or Swim England, formerly known as the Amateur Swimming Association (ASA), the only official training providers of swimming teaching in the UK. In addition, all Puddle Ducks teachers undergo full in-house training to ensure they meet our rigorous teaching standards. All of our teachers are insured through either the STA or the IOS (insurance body for Swim England) and hold a lifesaving and safeguarding qualification as well as a valid DBS check. 

    WE DRAW YOUR ATTENTION TO THE CONTENTS OF THE FOLLOWING CLAUSE

    4.        OUR RESPONSIBILITY TO YOU

    4.1      We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation.

    4.2      In the absence of any proven negligence, lack of due diligence or breach of duty by the teacher(s), Puddle Ducks Franchising Ltd, its franchisees or employees, your participation at one of our Aquanatal classes is done so entirely at your own risk.

    4.3      Puddle Ducks will not accept any liability for articles lost, damaged or stolen.

    4.4      Puddle Ducks cannot be held liable for the actions of third parties i.e. non-Puddle Ducks customers/team members and, therefore, excludes to the fullest extent possible by law, any liability arising from a breach of this section headed ‘Photography’ by any third party.

    4.5      These Terms and Conditions do not affect your statutory rights. 

    5.        WHAT TO WEAR

    5.1      You must wear appropriate swimwear in the pool (maternity swimsuits or a standard swimsuit with a maternity bra worn underneath), remove loose fitting or sharp jewellery, tie back long hair or wear a swim hat.

    5.2      All plasters and hair clips must be removed before swimming due to the risk of them falling off in the water and damaging the pool filters. 

    5.3      Strictly no outdoor footwear poolside.

    6.        HEALTH AND SAFETY 

    6.1      You must not attend Aquanatal classes if you have any illness such as an ear infection, chicken pox, impetigo, conjunctivitis or a bad cold. We have been advised that you should not attend for 48 hours after sickness and 2 weeks after suffering from diarrhoea. For any other illness and to avoid any doubt please wait until your doctor has given the all-clear before returning to classes.

    6.2      Swimmers should not enter the pool until the teacher says it is safe to do so and must tell the teacher if leaving the pool before the end of the session.

    6.3      All swimmers must shower before getting into the pool. Please do not wear makeup or body lotion etc. as these significantly deteriorate the quality of the pool water. 

    7.        PHOTOGRAPHY AND VIDEOS

    7.1      The taking of photographs and videos is not permitted during an Aquanatal class. If you wish a spectator to take photographs or video footage after the class has finished, you must adhere to the following terms:

    7.1.1  There must be no other class members in the background.

    7.1.2  You must adhere to pool rules at individual venues, some of which do not permit the use of such photographic equipment. If this is the case with your pool, we ask that you respect their policy.

    7.1.3  Photographs or videos where the pool is shared with members of the public will not be permitted.

    7.1.4  Puddle Ducks expressly forbids the right to reproduce any part of our lesson content in any form (e.g. on the internet, DVDs, photographs etc.)

    7.1.5  Anyone suspected of continually filming or photographing the lessons for any purpose of publication will be asked to stop filming and leave the class.

    7.1.6  The teacher or poolside assistant in that lesson has the right to view the photographs or videos taken and to delete any taken at the pool.

    7.1.7  In all instances the decision of the Puddle Ducks team member is final.

    8.        LOST PROPERTY AND VALUABLES 

    8.1      All property left within any pool building or grounds including but not limited to: car park, entrance, spectators’ areas, changing areas and poolside area, is left at your own risk.  Please make sure you have all your belongings with you before leaving.

    8.2      Lost property will be kept for a period of 3 weeks if found by a Puddle Ducks team member. If not claimed, it will be disposed of accordingly. Unfortunately, if an item is not found by a Puddle Ducks team member we cannot be held liable.

    8.3      Please note odds and ends lost property such as shampoo, socks etc. will be disposed of at the end of each day.

    9.        TEACHERS

    Whilst we will try to ensure you always have the same teacher in a particular class, we cannot guarantee this as teachers may fall ill, leave or cancel for personal reasons. On occasion we may also need to have a new teacher join or lead your lesson in order to complete their teacher training or assessments. The quality of your lesson will in no way be affected by this though.

    10.     DATA PROTECTION AND ONLINE SECURITY

    10.1   In order to book a Puddle Ducks Aquanatal class you must register your details with us. These will include your real name, mobile and landline phone numbers, email address, home address, emergency contact details, baby’s due date and any relevant conditions that could affect you whilst in the pool.

    10.2   We share information provided to us within the Puddle Ducks group. This includes all Puddle Ducks franchises and Puddle Ducks Head Office. This is in order to improve our service to you or to contact you by email to let you know of our other services e.g. our online shop.

    10.3   You can choose to unsubscribe to marketing emails at any time.

    10.4   Your name and due date will be displayed on our class registers in order to be used by our teachers to help tailor our classes to the individual needs of our customers. These registers are visible to other pool users and are used by selected pool operators for health and safety purposes.

    10.5   Please be assured that we will not share this data with any other third party other than those required to process your booking or where we are legally required to do so.

    10.6   On very rare occasions we may be obliged to disclose your personal information to third parties:

    10.6.1 Where we are legally required to disclose your information.

    10.6.2 To assist fraud protection and minimise credit risk.

    11.   OFFERS AND DISCOUNTS

     There are a selection of Offers and Discounts available to our customers but these are all subject to availability and valid at participating Franchises only.

    3.        OUR CONTRACT WITH YOU 

    3.1      How we will accept your order. Once an order has been placed you will receive an email from us which acknowledges your order and provides full details for you to check. A dispatch confirmation will then be sent to you in due course. Your order may be dispatched in several packages as some of our products are stocked at different locations. Please note that until we have sent your dispatch confirmation email your order has not been officially accepted by us and can be cancelled or amended if errors are found. We strongly advise you therefore to check the details of your order acknowledgement email immediately upon receipt and contact us by telephone if any amendments are required.

    3.2      Purchasing Gift Vouchers. If you order a Puddle Ducks gift voucher please note that the gift voucher will be emailed to both yourself and the recipient immediately upon ordering. If you find a mistake with the voucher (i.e. recipient email address, name, message or amount) please let us know asap. We will then cancel the voucher, issue a refund and ask you to place a new order with the correct voucher details.

    3.3      If we cannot accept your order. If we are unable to accept your order, we will inform you of this in writing and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because a credit reference we have obtained for you does not meet our minimum requirements, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified. Any products that are not listed on your dispatch confirmation email are, unfortunately, unavailable and will not be charged to you.

    4.        OUR PRODUCTS

    5.        RISK AND OWNERSHIP

    5.1      When you become responsible for the products. Our products will be your responsibility from the time we deliver the product to the address you gave us.

    5.2      When you own goods. You own a product once we have received payment in full.

    6.        PAYMENT AND PRICES

    6.1      Where to find the price for the product. The price of the product (which includes VAT) will be the price indicated on the order pages when you placed your order. We take all reasonable care to ensure that the price of the product advised to you is correct. However please see clause 1.3 for what happens if we discover an error in the price of the product you order.

    6.2      We will pass on changes in the rate of VAT. If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.

    6.3      What happens if we got the price wrong. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product's correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product's correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any goods provided to you.

    6.4      All payment details are taken by our secure online payment processor 'Sagepay' who are level 1 PCI DSS compliant. This means that they follow the highest security regulations for online payment processing.

    6.5      When you must pay and how you must pay. Full payment is required at time of ordering. We accept online payment by the following credit/debit cards: VISA, MasterCard and Maestro.

    6.6      You must confirm that you are the registered credit/debit card holder. Please note that validation and authorisation checks by the card issuer will be carried out on all transactions.

    6.7      If you are using a Puddle Ducks Shop gift voucher to pay or part pay for our products please note:

    6.7.1     No change can be given if the cost is less than the voucher value

     6.7.2    Our gift vouchers expire 6 months after the date of purchase 

    6.8      All of our prices include standard rate VAT where applicable.

    7.   DELIVERY

    7.1      All of our orders* are sent using DPD Monday-Friday Next Day delivery service. We aim to dispatch your parcel on the same day if the order is received before 1pm excluding weekends and Bank Holidays. We apologise but this service is currently only to Mainland UK addresses.

    * Except for swim badges & certificates and personalised swimbags which are sent by Royal Mail

    7.2      Once your order has been dispatched you will receive a one hour delivery window from DPD (if your products have been sent with them) via SMS text message (if you have provided us with your mobile number) or email. You will then be able to:

    7.2.1     Track the progress of your parcel on a map, counting down to a 15 minute window.

    7.2.2     Nominate a ‘Safe place’ for your parcel to be left if you are not going to be in.

    7.2.3     Upgrade your delivery to a DPD premium service such as Saturday or Sunday delivery or arriving before a specified time (NOTE: (i) you will incur extra charges for these services which are to be paid by yourself direct to DPD; and (ii) if you choose to upgrade we will not be liable for any refund of the standard delivery charge which you have paid to us.)

    7.3      Please supply accurate delivery address details. We will not be liable for any delays or problems caused by delivery information inaccuracies.

    7.4      We will not be liable if your parcel goes missing once it has been left in your designated safe place.

    7.5      If you are not in when your parcel delivery arrives and no safe place has been designated, the delivery person will leave a calling card and contact number so that you can re-arrange the delivery. Generally two further attempts to deliver will be made. If the parcel then has to be returned to us you will be liable for additional re-delivery costs or we will refund the item minus the delivery charges.

    7.6      If you do not receive your goods due to them being 'lost in the post' we reserve the right to ask you to wait 30 days, starting with the dispatch confirmation date, before a refund is given.

    7.7      On rare occasions dispatch and delivery may be affected by factors such as extreme weather conditions, strikes or holidays. We cannot be held liable for any delay to our service but we will do our utmost to keep you updated by email and/or website announcements.

    7.8      We apologise but at this time our quoted delivery rates are only for addresses within Mainland UK. For all other locations please contact us for a personal delivery quote.

    8.        FAULTY PRODUCTS

    8.1      What to do if a product is faulty - If you find a product to be faulty within 30 calendar days of receiving it please contact us via email stating your name, order number and nature of the problem. We will provide a replacement or full refund, whichever is your preferred option. If you find a product to be faulty after 30 calendar days but within 6 months of receiving it we are entitled to repair or replace it before offering a refund. In both instances we will cover the cost of the return postage.

    8.2      Summary of your legal rights. We are under a legal duty to supply products that are in conformity with this contract. See the box below for a summary of your key legal rights in relation to the product. Nothing in these terms will affect your legal rights.

    The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following:

    ·       up to 30 days: if your goods are faulty, then you can get an immediate refund.

    ·       up to six months: if your goods can't be repaired or replaced, then you're entitled to a full refund, in most cases.

    ·       up to six years: if your goods do not last a reasonable length of time you may be entitled to some money back.

    9.        CHANGING YOUR MIND 

    9.1      Exercising your right to change your mind (Consumer Contracts Regulations 2013). For most products bought online you have a legal right to change your mind within 14 days and receive a refund.  These rights, under the Consumer Contracts Regulations 2013, are explained in more detail in these terms.

    9.2      Tell us you have changed your mind -  If you change your mind for any reason please let us know by (i) emailing enquiries@puddleducks.com with your name, order number, details of the order and, where available, your phone number and email address or (ii) completing our order cancellation form and emailing it to enquiries@puddleducks.com.

    9.3      How to return the Products - Please return the goods to our address stating your name and order number, within 28 calendar days starting with the day after delivery.

    9.4      Change your mind refunds - We will be very happy to offer a refund unless the product has been personalised to your specifications. Please note that we can only refund our standard Next Day delivery cost (or a proportion of that if you have ordered multiple products but only returned some of them). NOTE: We will not refund any additional amount paid by you direct to DPD for any of their premium delivery services. Please return the goods to us in reasonable, un-used condition with packaging and swing tickets attached or included. We will process your refund within 14 calendar days of you returning the goods to us or you providing evidence of having returned the goods (for example, a proof of postage receipt from the post office), whichever is the sooner.

    9.5      Exchanges - Please note that we do not offer exchanges, we simply ask you to return the goods to us following the process above and place a new order for the required items.

     

    WE DRAW YOUR ATTENTION TO THE CONTENTS OF THE FOLLOWING CLAUSE

    10.   OUR RESPONSIBILITY FOR LOSS AND DAMAGE SUFFERED BY YOU

    10.1   We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation.

    10.2   If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

    10.3   We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

    10.4   We will take all reasonable care to keep your order information secure but we cannot be held liable for any loss you may suffer if any third party gains unauthorised access to any data you have provided whilst using our website.

    10.5   We take utmost care to ensure that all descriptions, prices and stock levels are correct at the time of entering them onto our website but we cannot guarantee that this information will not change over time.

    10.6   It is our responsibility to supply you with goods that meet your consumer rights. If you have any concerns that we have not met our legal obligations please contact us.

    10.7   If we make a genuine mistake with the pricing of any of our products we do not have to accept an order at the incorrect price.

    10.8   We reserve the right to remove products, change prices and amend services or descriptions at any time, without notice.

    10.9   These Terms and Conditions do not affect your statutory rights.

    11.     HOW WE MAY USE YOUR PERSONAL INFORMATION

    11.1   In order to purchase products from our website you must register your details with us. These will include your real name, phone number, email address, billing address and delivery address. The information that you provide will only be used for processing your order/delivery or updating you with regards to our services. Please be assured that we will not share this data with any third party outside the Puddle Ducks group other than those required to process your order/delivery.  

    11.2   How we will use your personal information. We will use the personal information you provide to us:

    11.2.1     to supply the products to you. This will include our delivery service provider ‘DPD’ using the provided information to enhance the delivery process to you. It will use notifications and geodata for that purpose. This may involve DPD sharing such details with limited third parties;

    11.2.2     to process your payment for the products; and

    11.2.3     if you agreed to this during the order process, to give you information about similar products that we provide, but you may stop receiving this at any time by contacting us.

    11.3   We will only give your personal information to other third parties where the law either requires or allows us to do so.

    12.     OUR RIGHTS TO END THE CONTRACT

    12.1   We may end the contract if you break it. We may end the contract for a product at any time by writing to you if:

    12.1.1     you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products, for example, details of where it is to be delivered;

    12.1.2     you do not, within a reasonable time, allow us to deliver the products to you;

    12.1.3     if we suspect fraudulent use of our website and services.

    12.2   You must compensate us if you break the contract. If we end the contract in the situations set out in clause 12.1 we will refund any money you have paid in advance for products we have not provided but we may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract.

    13.     CHANGES TO OUR TERMS AND CONDITIONS

    We reserve the right to make amendments to our Terms and Conditions at any time to reflect changes in our business or statutory obligations. The new version will be posted on our website and will take effect immediately upon posting. If applicable these changes will be communicated to all our customers by email. Previous versions of our Terms and Conditions will be available for reference on our website.

    14.     OTHER IMPORTANT TERMS

    14.1   We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation.

    14.2   You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

    14.3   Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

    14.4   If a court finds part of this contract illegal, the rest will continue in force.

    14.5   Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

    14.6   Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date 

    14.7   Which laws apply to this contract and where you may bring legal proceedings? These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.

  • TERMS AND CONDITIONS FOR PUDDLE DUCKS PHOTOSHOOTS (UNDERWATER or OVERWATER) - DECEMBER 2017 

    1.        OUR TERMS

    1.1      Please note that any mention of ‘Puddle Ducks’ in the terms and conditions set out below covers both Puddle Ducks branded Photoshoots/Classes and Swim Academy branded Photoshoots/Classes

    1.2      All those wishing to attend a Puddle Ducks photoshoot must agree to the terms and conditions set out below. In the unlikely event of a customer failing to abide by these terms and conditions, a customer may be requested to not attend or leave the photoshoot. In this instance Puddle Ducks will be under no obligation to provide a refund for any booking fees.

    1.3      What these terms cover. These are the terms and conditions on which we provide Puddle Ducks photoshoots to you. 

    1.4      Why you should read them. Please read these terms carefully before you book a space at one of our photoshoots. These terms tell you who we are, how we will provide you with a space at one of our photoshoots, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss. 

    2.        INFORMATION ABOUT US AND HOW TO CONTACT US

    2.1      Who we are. We are Puddle Ducks Franchising Ltd a company registered in England and Wales. Our company registration number is 05879603 and our registered office is at The Grain Store, Hollins Farm, Off Twemlow Lane, Holmes Chapel, Cheshire, CW4 8GE. Our registered VAT number is VAT no. 895926259.

    2.2      How to contact us. You can contact us by telephoning our customer service team at 01477 410085 or by writing to us at info@puddleducks.com.

    2.3      How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us when you booked.

    2.4      ”Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails. 

    3.        WHO CAN COME TO A PUDDLE DUCKS UNDERWATER PHOTOSHOOT 

    3.1      All children who are currently attending a Puddle Ducks or Swim Academy class, or have recently (less than 6 weeks prior to the photoshoot) finished attending a Puddle Ducks or Swim Academy class and are therefore registered with Puddle Ducks/have a Puddle Ducks account log-in. 

    3.2      All children must have attended at least four lessons so that the teacher can assess your child as to their suitability for the shoot.  We need to see consistent, happy, head down swimming as we do not force any of our children under the water on the photoshoots. If your child is not consistently happy when they are underwater they should not attend. 

    3.3      We recommend that all children attending one of our underwater photoshoots are more than 12 weeks old. 

    3.4      If you are booking a space at one of our photoshoots online, please note that you are unable to book a child that is registered with Puddle Ducks but not with yourself as the parent/carer. They must be booked in by their own parent/carer under their own Puddle Ducks log-in.

    3.5      Siblings or friends over two years of age who do not attend Puddle Ducks or Swim Academy lessons are able to attend one of our underwater photoshoots with you, and be booked in online, but you MUST have spoken to your teacher about the said child to determine if they are suitable to attend the particular photoshoot. You must complete an online waiver for the child (as part of the booking process) and agree to these full terms & conditions for that child. 

    3.6      Every child attending a photoshoot must be accompanied by their own responsible adult. One adult cannot be responsible for more than one child. See section 5.6.1. 

    4.         WHO CAN COME TO A PUDDLE DUCKS OVERWATER PHOTOSHOOT 

    4.1      Overwater photoshoots are suitable for all ages and levels, so even new swimmers can attend. There is no need to speak to your teacher before booking a space at one of these events if you currently swim with Puddle Ducks and have a Puddle Ducks account log-in.

    4.2      If you are booking a space at one of our photoshoots online, please note that you are unable to book a child that is registered with Puddle Ducks but not with yourself as the parent/carer. They must be booked in by their own parent/carer under their own Puddle Ducks log-in.

    4.3      Siblings or friends of any age who do not attend Puddle Ducks or Swim Academy lessons are able to attend one of our overwater photoshoots with you and be booked in online. You must complete an online waiver for the child though (as part of the booking process) and agree to these full terms & conditions for that child.

    4.4      Every child attending a photoshoot must be accompanied by their own responsible adult. One adult cannot be responsible for more than one child. See section 5.6.1.

    5.        OUR CONTRACT WITH YOU 

    5.1      Booking a photoshoot

    5.1.1  You can make a photoshoot booking online at www.puddleducks.com (please note 3.4 and 4.2) or over the phone if you are registered with the Puddle Ducks office who are running the shoot. If you are registered with a different Puddle Ducks office you must book online. 

    5.1.2  You must provide us with specific personal information in order to book a photoshoot with us. Full details of the information required is in our ‘Data Protection and online security’ section.

    5.1.3  Once your booking has been processed you will receive a ‘booking fee payment confirmation’ email at which point a contract will come into existence between you and us.

    5.1.4  We are unable to accept Puddle Ducks gift vouchers as payment for photoshoot booking fees.

    5.1.5  Photoshoot timings are as advertised. We will allocate you a specific session time, via email, once your booking is made. We will ask you if you have a preferred session time during the booking process. We will do our best to accommodate any requests but cannot guarantee that this will be possible. Puddle Ducks will be under no obligation to provide a refund for any booking fees if we are unable to accommodate your timing request.

    5.1.6  Photoshoots are run as separate events to our regular classes. Your photoshoot booking fee will be taken separately to your regular class payment and will not affect your regular class payment due dates.

    5.1.7  All of our prices include standard rate VAT where applicable.

    5.2         Ordering and Paying for photographic products

    5.2.1  Your photoshoot booking fee payment does not include any photographic products such as prints, canvases or digital downloads.

    5.2.2   A few days after the photoshoot we will email you with details to give you online viewing access to the image(s) taken of your child(ren). You will then have the opportunity to order these in a variety of formats such as prints, canvases or digital downloads. Payment will be taken at the point of ordering.

    5.2.3  Please contact the local office running the photoshoot for an up-to-date price list for the particular photoshoot that you are booking a space at.

    5.2.4  Payments for any of our photographic products are non-refundable unless you receive damaged or faulty goods.

    5.2.5  We are unable to accept Puddle Ducks gift vouchers as payment for any of our photographic product. 

    5.2.6  All of our photographic product prices include standard rate VAT where applicable.

    5.3      Last minute photoshoot changes or cancellations by Us

    5.3.1  In the unlikely event of a photoshoot cancellation by us, you will be notified by us by text message to your mobile phone, with as much notice as possible. Puddle Ducks will not reimburse any expenses caused by a customer failing to pick up their message.

    5.3.2  A photoshoot could be cancelled by us for a number of reasons, the key one being if the quality of water at the pool on the day is below our standards required for a successful shoot. If we have to cancel we will offer you an alternative date or a full refund of your booking fee.

    5.3.3  If your photoshoot is cancelled part way through we will offer you an alternative date or part refund of your booking fee. You will only be refunded if you were in attendance, and for the part of the photoshoot that had to be cancelled, on a pro-rata basis. If no photos have been taken of your child before the photoshoot is cancelled you will be offered an alternative date or full refund of your booking fee.

    5.3.4  If insufficient children are booked into your photoshoot, we reserve the right to cancel the photoshoot. In this instance we will offer you either an alternative date or a full refund of your booking fee.

    5.4      Cancellation Rights and Refund Policy

    5.4.1  The cancellation rights generally available to consumers in accordance with their statutory rights do not apply to the photoshoots provided by us. 

    5.4.2  Due to the nature of running these photoshoots, we offer a no-refund policy on booking fees. If you cancel before the shoot takes place though and your space is able to be filled you may, at the discretion of the local Puddle Ducks office, be offered a partial refund (your booking fee minus a £20 admin fee).

    5.4.3  Unfortunately, due to the nature of underwater and overwater photoshoots and variables such as your child’s demeanour on the day, we cannot guarantee that we will be able to take an image to your liking. In these instances we will not be liable to provide a refund of your booking fee.

    5.5      Changes to our terms and conditions

    We reserve the right to make amendments to our Terms and Conditions at any time to reflect changes in our business or statutory obligations. The new version will be posted on our website and will take effect immediately upon posting. If applicable these changes will be communicated to all our customers by email. If you book a photoshoot after the new Terms and Conditions have come into effect as part of your booking process you will indicate your agreement to be bound by them. Previous versions of our Terms and Conditions will be available for reference on our website. 

    5.6      Behaviour and responsibilities

    5.6.1  All children attending a photoshoot must be accompanied in the water by their adult carer regardless of their swimming ability.

    5.6.2  Customers are responsible for the child in their care at all times and must inform a member of the photoshoot team, prior to entering the water at the photoshoot, of any concerns they have.

    5.6.3  Customers are expected to behave in a civilised manner towards any member of the photoshoot team, other Puddle Ducks customers and any members of the public who are using the same pool, and are expected to refrain from using foul language at all times.

    5.6.4  Puddle Ducks may, at its own discretion, refuse entry to a customer if it is felt that the customer’s behaviour is unacceptable.

    5.6.5  Customers accept that at times there will be physical contact between members of the photoshoot team and their child, which will always be carried out in a professional and caring manner. 

    5.6.6  It is the customer’s responsibility to inform the local office and photoshoot team of any condition that could affect their or their child’s capabilities in the swimming pool. You must agree to inform us of any changes, including pregnancy, as soon as you become aware of them. All information provided to us will be treated as strictly confidential.

    5.6.7  Unfortunately, we can only accommodate one person in the pool at a time with each child who must be either the child's parent or designated carer and be at least 18 years of age. Spectators may be allowed, depending on individual pool facilities and regulations, but must be other family members or friends. Please check with your local office before attending each photoshoot as individual pool regulations can change without notice.

    5.6.8  Customers must follow pool procedures as advised to them at the time of confirmation. Please adhere to the instructions given to you regarding car parking, entry and exit route to pools.

    5.6.9  Customers should aim to arrive no more than 15 minutes before their booked photoshoot space and leave no more than 15 minutes after the photoshoot space to help improve changing room comfort.

    5.6.10  Car seats and push-chairs etc. should not be left in the changing rooms. Please contact the local office for details of where these can be left as this will depend on the individual pool facilities. There is strictly no push-chairs poolside at any pool.

    5.6.11  Food is strictly forbidden in the pool buildings.

    5.6.12  Please minimise mess on the floor e.g. mud or grass. Please inform a Puddle Ducks team member or pool staff if the floor is soiled.

    5.6.13  Smoking is strictly forbidden within any pool building or grounds.

    5.6.14  All Puddle Ducks teachers hold a teaching qualification from either the Swimming Teacher’s Association (STA) or Swim England, formerly known as the Amateur Swimming Association (ASA), the only official training providers of swimming teaching in the UK. In addition, all Puddle Ducks teachers undergo full in-house training to ensure they meet our rigorous teaching standards. All of our teachers are insured through either the STA or the IOS (insurance body for Swim England) and hold a lifesaving and safeguarding qualification as well as a valid DBS check.

    5.6.15  The safety and well-being of your child or the child in your care is of the upmost importance to Puddle Ducks. We have a responsibility to report any inappropriate or suspicious behaviour to the relevant authorities.

    WE DRAW YOUR ATTENTION TO THE CONTENTS OF THE FOLLOWING CLAUSE

    6.         OUR RESPONSIBILITY TO YOU

    6.1      We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation.

    6.2      In the absence of any proven negligence, lack of due diligence or breach of duty by the photoshoot team(s), Puddle Ducks Franchising Ltd, its franchisees or employees, the participation of you, your spouse/partner, child or those in whose care you have placed your child for the purpose of attending or observing Puddle Ducks photoshoots is done so entirely at your and their own risk.

    6.3      Puddle Ducks will not accept any liability for articles lost, damaged or stolen.

    6.4      Puddle Ducks cannot be held liable for the actions of third parties i.e. non-Puddle Ducks customers/team members and, therefore, excludes to the fullest extent possible by law, any liability arising from a breach of the section headed ‘9. Photography and Videos’ by any third party.

    6.5      Our Underwater and Overwater photoshoots are carried out in accordance with PAS 520:2017 (Safeguarding 0 to 4 year old children within the teaching of swimming, including any associated professional photography – Code of practice)

    6.6      These Terms and Conditions do not affect your statutory rights.

    7.        WHAT TO WEAR

    7.1      We operate a strict ‘double nappy’ policy for those children in Puddle Ducks classes Floaties, Splashers, Kickers and for any other children not yet fully toilet trained.  An approved snug-fitting neoprene swim nappy (such as our Puddle Ducks neoprene swim nappy or one of a similar design i.e. with snug fitting cuffs at the waist and legs) must be worn with a swim under-nappy (either a disposable paper swim nappy or a reusable cotton swim nappy with a disposable liner) underneath. Please gain approval from your local Puddle Ducks office if you are planning to use a neoprene swim nappy other than those available from our online shop. Children are welcome to wear swimming costumes, swim trunks, baby wetsuits and other similar garments but must still wear the ‘double nappy’ underneath if not fully toilet trained. Puddle Ducks reserves the right to refuse entry to any child who is not suitably dressed. 

    7.2      Children must remove loose fitting or sharp jewellery before swimming. Hoop earrings are not permitted.

    7.3      Adults must wear appropriate swimwear in the pool, remove loose fitting or sharp jewellery and are advised to tie back long hair.

    7.4      All plasters and hair clips must be removed before swimming due to the risk of them falling off in the water and damaging the pool filters.

    7.5      Strictly no outdoor footwear poolside.

    8.        HEALTH AND SAFETY 

    8.1      You must not bring your child to a photoshoot if they have any illness such as an ear infection, chicken pox, impetigo, conjunctivitis or a bad cold. We have been advised that you should not bring your child into the pool for 48 hours after sickness and 2 weeks after suffering from diarrhoea. For any other illness and to avoid any doubt please wait until your doctor has given the all-clear before attending a photoshoot.

    8.2      Swimmers should not enter the pool until a member of the photoshoot teams says it is safe to do so and must tell a member of the photoshoot team if leaving the pool before the end of the session.

    8.3      Always change your baby on the floor using a suitable changing mat. Do not use any raised areas such as benches, trolleys or tables. This is to prevent babies from rolling onto the floor from high surfaces which can easily happen and is extremely distressing for all concerned.

    8.4      Please take all your used nappies away with you unless a clearly marked nappy bin has been provided. Never leave nappies in an open bin (including those within the venue grounds).Please do not run or allow your child to run on the pool side, drink alcohol prior to the lesson, eat or chew gum during the photoshoot.

    8.5      All swimmers must shower before getting into the pool. Please do not wear makeup or body lotion etc. as these significantly deteriorate the quality of the pool water. 

    9.        PHOTOGRAPHY AND VIDEOS

    9.1      The taking of photos or recording of videos is strictly forbidden by any customers attending a Puddle Ducks photoshoot. Any customer found to be doing so will be asked to leave immediately.

    10.     LOST PROPERTY AND VALUABLES 

    10.1   All property left within any pool building or grounds including but not limited to: car park, entrance, spectators’ areas, changing areas and poolside area, is left at your own risk.  Please make sure you have all your belongings with you before leaving.

    10.2   Lost property will be kept for a period of 3 weeks if found by a Puddle Ducks team member. If not claimed, it will be disposed of accordingly. Unfortunately, if an item is not found by a Puddle Ducks team member we cannot be held liable.

    10.3   Please note odds and ends lost property such as shampoo, dummies, socks etc. will be disposed of at the end of each day.

    11.     DATA PROTECTION AND ONLINE SECURITY

    11.1   In order to book a Puddle Ducks photoshoot you must register your details and those of your child(ren) with us. These will include your real name, mobile and landline phone numbers, email address, home address, your child’s date of birth, emergency contact details and any relevant conditions that could affect you or your child whilst in the pool.

    11.2   We share information provided to us within the Puddle Ducks group. This includes all Puddle Ducks franchises and Puddle Ducks Head Office. This is in order to improve our service to you or to contact you by email to let you know of our other services e.g. our online shop.

    11.3   You can choose to unsubscribe to marketing emails at any time.

    11.4   The names of you and your child(ren), a colour coded indication of any relevant medical conditions of you and your child(ren) and your child(ren)’s class level, if applicable, will be displayed on our photoshoot registers in order to be used by our photoshoot team members to help tailor our photoshoots to the individual development stage of your child(ren). These registers are visible to other pool users and are used by selected pool operators for health and safety purposes.  

    11.5   Please be assured that we will not share this data with any other third party other than those required to process your booking or where we are legally required to do so.

    11.6   On very rare occasions we may be obliged to disclose your personal information to third parties:

    11.7   Your email address will be used to create your ‘My Puddle Ducks’ account on our website and for all photoshoot communications. By providing us with an email address you are agreeing to receive communication from us by email.

    11.8   Any payment card details that you choose to save within our payment system will be held 100% securely by our payment processor ‘Sagepay’ who are PCI DSS Level 1 compliant.

    11.9   Your privacy and data security are of paramount importance to us but unfortunately the Internet is not a 100% secure channel of communication. Any data sent electronically to us is done so entirely at your own risk. Where you have chosen a password, to access certain parts of our website, you are responsible for keeping this password confidential.

    12.     COPYRIGHT OF IMAGES

    In line with the 1988 Copyright Act, all ownership of the copyright of the images obtained at a Puddle Ducks photoshoot sits with the photographer. Please can you therefore ensure that any purchased images are for personal use only; are not used in the promotion of any business/service/charity other than Puddle Ducks; and cannot be used in the production of any marketing or promotional materials without Puddle Ducks’ prior written consent.

    14.     PUDDLE DUCKS COMPLAINTS PROCEDURE

    14.1   We hope you will be delighted with our service but if you are at all unhappy please follow our complaints procedure:

    14.1.1  Speak to a member of the photoshoot team or telephone the local Puddle Ducks office

    14.1.2 If the response is not satisfactory, please email a written complaint to the local Puddle Ducks office.

    14.1.3 If the response from the local Puddle Ducks office is not satisfactory, a written complaint should be submitted for the attention of the Office Manager at Puddle Ducks Head Office to the address above (see 2.2).

    15.     OTHER IMPORTANT TERMS

    15.1   We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation.

    15.2   You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

    15.3   Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

    15.4   If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

    15.5   Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

    15.6   Which laws apply to this contract and where you may bring legal proceedings? These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
